2. The prize competition

SMS 30th Anniversary Prize Competition

2.1 Promoter is launching a prize competition to celebrate the SMS 30th anniversary. The prize competition will be provided in a quiz format via a chatbot. Responses to the quiz  questions will be via messaging. You must answer correctly and quickly. See Condition 3.3. on how to enter the competition.

3. Agreement to the terms and conditions and decisions.

By participating, you fully and unconditionally agree to be bound by and accepts these Terms and Conditions, and the decisions of Promoter (including, without limitation, decisions regarding eligibility of entries, the selection of entrants and the winner, and the awarding of the prize), which are final and binding in all respects.

4. How to enter

4.1 The competition will run from 9am Greenwich Mean Time (“GMT”) on 28 November 2022 (the “Opening Date”) to 5pm GMT on 3 December 2022 (the “Closing Date”) inclusive (the “Entry Period”).

4.2 All competition entries must be received by the Promoter through the method of entry specified in Sec. 3.3 by no later than 5pm EST on the Closing Date. All competition entries received after the Closing Date are automatically disqualified.

4.3 Promoter’s selected device is the official timekeeping device for the Prize Competition.

4.4  To enter the competition:

(a) Scan QR code or Send SMS – Hi to number +447860041708.

(b) complete the entry form with full name and email address, which can be found  in  chatbot by the Closing Date.

(c) Chatbot is available via SMS channel, quiz and entry form are in the chatbot. Respond to the bot over SMS channel. 

4.5 No purchase necessary. Standard text message rates and carrier charges may apply.

4.6 The Promoter will not accept responsibility for competition entries that are lost, mislaid, damaged or delayed in transit, regardless of cause, including, for example, as a result of any postal failure, equipment failure, technical malfunction, systems, satellite, network, server, computer hardware or software failure of any kind or proof of posting or transmission as proof of receipt of entry to the competition.

4.7 The winning competition entry will be based on the following criteria:

(a) must answer five (5) questions correctly via a chatbot through SMS channel, and

(b) must have the fastest response time in answering the questions correctly. The decision of the Promoter (acting reasonably) will be final.

4.8 If a judge or panel of judges is applicable, the Promoter will send the full names of the judge(s) to anyone who writes within one month after the Closing Date of the competition requesting details of the judges and who encloses a self-addressed envelope to the address set out in INFOBIP LTD., 34-38 New Bridge Street, London, EC4V 6BW.

4.9 This Contest is not sponsored, endorsed, administered by, or associated with Facebook, Twitter, or Linkedin. You understand that you are providing information to Promoter and not to Facebook, Twitter, or Linkedin.

5. Eligibility

5.1 The competition is only open to all residents in the UK, aged 18 years or over, except:

(a) employees of the Promoter or its holding or subsidiary companies;

(b) employees of agents or suppliers of the Promoter or its holding or subsidiary companies, who are professionally connected with the competition or its administration; or

(c) members of the immediate families or households of (a) and (b) above.

5.2 In entering the competition, you confirm that you are eligible to do so and eligible to claim the prize or any prize you may win. The Promoter may require you to provide proof that you are eligible to enter the competition.

5.3 The Promoter will not accept competition entries that are: (a) automatically generated by computer; (b) completed by third parties or in bulk; (c) illegible, have been altered, reconstructed, forged or tampered with; (d) photocopies and not originals; or incomplete.

5.4 There is a limit of one entry per person per day during the Entry Period. Entries on behalf of another person will not be accepted and joint submissions are not allowed.

5.5 The Promoter reserves all rights to disqualify you if your conduct is contrary to the spirit or intention of the prize competition.

6. The prize

6.1 A trip for two (2) for the Prize Competition winner and a guest, to Croatia consisting of airfare and hotel accommodations for three (3) nights and four (4) days stay at the first rate hotel selected by the Promoter, a tour of the Promoter campus located in Utinjska Ulica 29 1000, Zagreb, Croatia and a CX professional consultation with a retail value of approximately equivalent to five thousand United States dollars United States  (US $5,000.00) prize(s) will be awarded in this Contest to one (1) winner. The total approximate retail value of the prizes are fifteen thousand United States dollars (US $15,000.00). Airfare and hotel accommodations approximate retail value may vary depending on availability and departure location. One (1) prize is available to be won. Prize Competition winner and guest must travel together on the same itinerary (in Promoter’s and/or prize supplier(s) sole discretion). Prize Competition winner’s guest must be aged 18 years or over. If winner elects to travel without a guest(s), no additional compensation will be awarded. Prize Competition winner and guest, if any, must travel together on the same itinerary and all trip components must be taken together on the same trip. Trip is subject to air/ground travel availability, hotel/stateroom availability, holiday and blackout dates and all other prize and travel restrictions, as applicable.

6.2 The trip is provided by the selected air travel and hotel supplier by Promoter. This Prize Competition is in no way sponsored, endorsed or administered by, or associated with the prize supplier for airfare and hotel prize

6.3 The trip is for two (2) to travel via economy class tickets to Zagreb, Croatia for three (3) nights and four (4) days stay between  April 2023  and August 2023. The prize does not include any incidentals, travel insurance, the cost of transfers to and from airports or stations, food and drink, spending money, tax or personal expenses. Any other costs incurred in addition to those set out above and that are incidental to the fulfilment of the prize are the responsibility of the winner(s).

6.4 You will be responsible for ensuring that you and your guest or any person travelling with you are available to travel and hold valid passports, any necessary visas and travel documents for the trip in question on the travel dates specified, including required immunization if applicable. Dates once notified to the travel agent cannot be changed.

6.5 Prizes are subject to availability. There is no cash alternative for the prize. The Promoter reserves the right to substitute the prize with a prize of equal or greater value.

6.6 The prize is supplied by a selected air travel and hotel accommodation supplier by Promoter and CX professional consultation is supplier by Infobip. The Promoter reserves the right to replace the prize with an alternative prize of equal or higher value if circumstances beyond the Promoter’s control makes it necessary to do so.

6.7 Prize must be accepted as awarded, and prize is awarded “AS IS” with no warranty, representation or guarantee, express or implied, in fact or in law, made by Promoter or for which Promoter shall be liable, including, without limitation, ANY IMPLIED WARRANTIES OF MERCHANTABILITY, NON-INFRINGEMENT OR FITNESS FOR A PARTICULAR PURPOSE. This Prize Competition is in no way sponsored, endorsed or administered by, or associated with the prize supplier for airfare and hotel prize.

6.8 The prize is not negotiable or transferable. In order to claim the prize, see Condition 7.

7. Winners

7.1 The decision of the Promoter, or the judge(s) nominated by the Promoter if applicable, is final and no correspondence or discussion will be entered into.

7.2 The Promoter will contact the winner personally as soon as practicable after the Announcement Date, using the telephone number or email address provided with the competition entry. The Promoter will not amend any contact information once the competition entry form has been submitted.

7.3 The Promoter must either publish or make available information that indicates that a valid award took place. To comply with this obligation the Promoter will publish the surname and county of major prize winners and, if applicable, the winning entry on LinkedIn, Twitter, and Facebook] on 6 December 2022 (“Announcement Date”) or send the surname and county of major prize winner and, if applicable copies of the winning entry, to anyone who emails [email protected] or writes to the address set out in Condition 1 (enclosing a self-addressed envelope) within one month after the Closing Date of the competition.

7.4 If you object to any or all of your surname, county and winning entry being published or made available, please contact the Promoter [email protected]. In such circumstances, the Promoter must still provide the information and winning entry to the Advertising Standards Authority on request.

7.5 All entrants and entries are subject to verification prior to the awarding of a prize based on the eligibility, age and other claims of/information provided by a prize winner. The potential winner may be required to execute and return to Promoter a notarized Affidavit of Eligibility, a Liability Release, and, except where prohibited by law, a Publicity Release (an “Affidavit/Release”) in the form(s) provided by Promoter in order to claim his/her prize. The Affidavit/Release must be returned to Promoter by the date and/or time indicated.

8. Claiming the prize

8.1 In claiming the prize, if you are the winner of the prize, you will have five (5)  days from the Announcement Date to claim the prize by contacting the Promoter by email at [email protected]. If you do not claim the prize by this date, your claim will become invalid.

8.2 The prize may not be claimed by a third party on your behalf.

8.3 The Promoter will make all reasonable efforts to contact the winner. The winner may be required to execute and return to Promoter a notarized Affidavit of Eligibility, a Liability Release, and, except where prohibited by law, a Publicity Release (an “Affidavit/Release”) in the form(s) provided by Promoter in order to claim the prize.  If the winner cannot be contacted or is not available, or has not claimed their prize within five (5)  days of the Announcement Date, or if the winner fails to return the Affidavit/Release within the specified time, or if any prize or prize notification is returned as undeliverable, or if the potential winner is found to be ineligible, or if the winner does not comply with the Terms and Conditions or at the requests of Promoter, then the winner may be disqualified and the Promoter reserves the right to offer the prize to the next eligible entrant selected from the correct entries that were received before the Closing Date based on the winner criteria described in Condition 4.9.

8.4 The Promoter does not accept any responsibility if you are not able to take up the prize.

9. Limitation of liability.

To the extent permitted by law,  the Promoter, its agents or distributors will not in any circumstances be responsible or liable to compensate the winner or accept any liability for any (a) incorrect or inaccurate transcription of entry information or late, lost, stolen, unintelligible, illegible, damaged, mutilated, altered, incomplete or misdirected entries or entries received through impermissible or illegitimate channels, all of which will be disqualified; (b) technical failures of any kind, including but not limited to the malfunctioning of any telephone, computer online systems, computer equipment, website, server provider, network, hardware or software; (c) the unavailability or inaccessibility of any website or service; (d) unauthorized intervention in any part of the entry process or the Contest; (e) printing, typographical, electronic or human errors, which may occur in the offer or administration of the Contest or the processing of entries; or (f) loss, damage, personal injury or death occurring as a result of taking up the prize except where it is caused by the negligence of the Promoter, its agents or distributors or that of their employees. Your statutory rights are not affected.

10. Release

To the extent permitted by law, by entering, you are and will forever, fully and irrevocably releases and holds harmless Promoter and its parents, subsidiaries and affiliates, and their respective agents, advertising and promotion agencies, affiliates, Prize Competition partners and prize suppliers, Facebook, Twitter, Linkedin, and all of their respective employees, officers, directors, shareholders and agents from and against all claims, damages or liabilities arising in whole or in part, directly or indirectly, from your participation and/or entry in the Prize Competition and/or your award, receipt or use of any prize awarded in the Prize Competition.

11. Ownership of competition entries and intellectual property rights

11.1 All competition entries and any accompanying material submitted to the Promoter, if any, will become the property of the Promoter on receipt and will not be returned.

11.2 By submitting your competition entry and any accompanying material, you agree to:

(a) assign to the Promoter all your intellectual property rights with full title guarantee; and

(b) waive all moral rights, in and to your competition entry and otherwise arising in connection with your entry to which you may now or at any time in the future be entitled under the Copyright, Designs and Patents Act 1988 as amended from time to time and under all similar legislation from time to time in force anywhere in the world. You agree to grant the Promoter a non-exclusive, worldwide, irrevocable licence, for the full period of any intellectual property rights in the competition entry and any accompanying materials, to use, display, publish, transmit, copy, edit, alter, store, re-format and sub-licence the competition entry [and any accompanying materials for such purposes.

11.3 You agree that the Promoter may, but is not required to, make your entry available on its website  and any other media, whether now known or invented in the future, and in connection with any publicity of the competition.

12. Data protection and publicity

The Promoter will only process your personal information as set out in the: https://www.infobip.com/policies/privacy.  See also Condition 6.3 and Condition 6.4, with regard to the announcement of winners. In addition, you consent to receive future information from Infobip Ltd., and its affiliated companies and Infobip Ltd. may use the information provided to initiate, maintain and develop a relationship with you in connection with offering any of Infobip Ltd.’ products and services; or to promote and market to you additional products and services offered by Infobip Inc. 13. General

If there is any reason to believe that there has been a breach of these terms and conditions, the Promoter may, at its sole discretion, reserve the right to exclude you from participating in the competition. The Promoter reserves the right to hold void, suspend, cancel, or amend the prize competition where it becomes necessary to do so. These Terms and Conditions shall be governed by English law, and the parties submit to the non-exclusive jurisdiction of the courts of England and Wales.
